HC upholds life sentence of MP chemistry teacher in murder case
Bhopal/Jabalpur, July 30 -- The Madhya Pradesh High Court on Tuesday upheld a lower court's sentence of life imprisonment to a retired chemistry professor who had cited scientific textbooks while arguing against the prosecution's evidence for killing her husband. During a hearing before a divisional bench of judge Vivek Agrawal and judge Devnarayan Mishra in April this year, the accused, Mamta Pathak, 64, argued that there were flaws in the postmortem report, especially on the time and cause of death, citing theories from a science book.
Then, judge Vivek Agrawal had asked, "Are you a chemistry professor?"
The video of the hearing was widely circulated on social media. But on Tuesday while pronouncing the judgement, the division bench rejected her appeal against the verdict.
On June 29, 2022, a lower court had convicted Pathak under Section 302 and sentenced her to undergo rigorous imprisonment for life with fine of Rs.10,000. The doctors who carried out the post-mortem examination of her husband, Dr. Neeraj Pathak, had opined that he died from electrocution.
Pathak had argued that the prosecution's case was based on the presumption that she frequently quarrelled with her husband suspecting his fidelity, but the evidence was neither relevant nor scientific and did not connect her with the alleged offence. Citing a textbook on medical jurisprudence and toxicology, she questioned how the post-mortem report could have shown that he died 36 to 72 hours before the examination. She also pointed out that it is not possible to differentiate between antemortem and postmortem electrical burns, referring to a textbook on forensic science.
However, the high court held that the arguments raised by Pathak could not rule out the time of death and the cause of death presented by the post-mortem report....
