HC takes serious note of STF acting on a pvt complaint
PRAYAGRAJ, Jan. 14 -- Taking a serious note of the cognizance taken by the Special Task Force (STF) on a private complaint moved by a man in connection with an alleged appointment made in a school on the basis of fake documents, the Allahabad high court has directed the ADG, UP STF, Amitabh Yash to either appear before it personally or through videoconferencing on January 15.
The STF took cognizance of a complaint made by one Tulsi Ram against the appointment of the petitioner Jai Chandra Maurya, who was working as class 4 employee in the Adarsh Madhyamik Vidyalay, Saraipeetha Shahipur, Prayagraj.
It was alleged that the petitioner fabricated his date of birth. After taking cognizance, the STF started investigating the matter. On the STF's report, the district inspector of schools passed a direction withholding the post-retiral benefits to the petitioner which was challenged.
While hearing the writ petition, Justice SS Shamshery on January 12 expressed dissatisfaction with the explanation given by Amitabh Yash through video conferencing.
The additional chief standing counsel, who appeared for the state (respondents) and other officers present in the high court, were also not able to show any document in the given set of facts as to how the STF can take cognizance on the basis of a private complaint without going through the judgments on the issue.
On this, the court said, "If the matter is so serious then why even till date the Committee of Management or District Inspector of School (DIOS) concerned have not taken any single step against the petitioner."...
