HC stays Ukhand govt's abeyance of forest officer's promotion
Dehradun, Dec. 13 -- Uttarakhand high court has stayed an order of the state government that had kept in abeyance the promotion of a forest officer on the ground that a charge sheet was issued against him before the promotion
The court said that since the chargesheet was served on the employee only after the Departmental Promotion Committee (DPC) meeting, the promotion could not have been withheld.
Hearing a petition filed by Kuldeep Singh, a forest official, Justice Manoj Kumar Tiwari on Thursday said that the suspension was not justified in light of Supreme court precedents.
Abhijay Negi, counsel of the petitioner, said Kuldeep Singh joined the forest department as a forester in 1995 and was promoted to deputy forest ranger in 2013.
On the recommendation of the Uttarakhand Public Service Commission, he was promoted to Forest Range Officer (FRO) on June 10, 2024, and joined duties on June 12.
"Two days later, however, the government issued an order on June 14 placing his promotion under abeyance on the ground that a charge sheet had been issued on May 4", he said.
Negi said he argued that although the charge sheet bore the date May 4, it was served on Singh only on May 13, after the DPC meeting held on May 6....
