Lucknow, July 9 -- The Lucknow bench of the Allahabad high court has stayed the state government's suspension order of the then Kanpur chief medical officer Dr Haridutt Nemi and the appointment of the new CMO Dr Udaynath. The state government appointed Dr Udaynath, additional CMO from Shravasti, as the new CMO of Kanpur on June 19. The same day (June 19), the state government had suspended Dr Nemi following a high-profile bureaucratic standoff in which he was embroiled in months of tension with Kanpur district magistrate Jitendra Pratap Singh. A single-judge bench of Justice Manish Mathur stayed the suspension of Dr Nemi on July 7. The order was uploaded on the high court website on Tuesday. Senior advocate LP Mishra appeared on behalf of Dr Nemi in court. The court observed that the state government issued a show cause notice on May 16 to which the petitioner replied on May 27, but the suspension order was passed without taking into consideration Dr Nemi's reply. Mishra said a new CMO was posted in place of the petitioner prior to passing the suspension order. "It has been submitted that a bare perusal of the impugned suspension order (June 19) will make it evident that petitioner's suspension has been resorted to without any initiation of inquiry proceedings or even in contemplation thereof," the court said. "It is submitted that even otherwise the allegations as levelled in the order (June 19) would not result in any major penalty and, therefore, suspension could not have been resorted to in terms of U.P. Government Servants (Discipline and Appeal) Rules 1999," the court added....
