PRAYAGRAJ, July 16 -- The Allahabad High Court on Tuesday stayed the arrest of cricketer Yash Dayal in connection with an FIR lodged against him at Ghaziabad alleging that he had sexually exploited a woman for five years on the pretext of marriage. Hearing a writ petition filed by Yash Dayal, who plays for Royal Challengers Bangalore (RCB), a division bench comprising justice Siddhartha Varma and Justice Anil Kumar also directed the state counsel to file counter affidavit (reply) in the matter. The court also issued notice to the complainant woman asking her to file a counter affidavit in the matter. In his writ petition, Yash Dayal had sought stay of his arrest in the matter as well as quashing of the FIR registered against him at Ghaziabad. It was argued by petitioner's counsel that during the period of five years, it cannot be expected that the petitioner kept on deceiving the victim while she believed him during the period. As per facts of the case, a first information report (FIR) was registered against Yash Dayal at Indirapuram police station in Ghaziabad on July 6 under section 69 (sexual intercourse by employing deceitful means etc.) of Bhartiya Nyaya Sanhita (BNS). It is alleged in the FIR that Dayal sexually exploited a woman on the pretext of marriage. According to the complainant woman, she met Yash Dayal around five years ago and the latter promised to marry her. The alleged victim woman also claimed that Dayal kept postponing her proposal to marry and eventually, she came to know Dayal was involved with some other women as well.
