HC slams state govt for non-compliance
Jodhpur, Aug. 24 -- The Rajasthan high court came down heavily on the state government for failing to comply with its earlier directions regarding alleged irregularities in the Farmer Loan Waiver Scheme-2019, remarking that the conduct of the state gives an impression of attempting to "cover up" rather than cooperate with the court.
A division bench of chief justice KR Shriram and justice Sandeep Taneja passed the order while hearing writ petitions filed by Simartha Ram, Bhanwarlal and others, who had highlighted large-scale financial irregularities under the loan waiver scheme implemented through co-operative societies. At the outset, petitioners' counsel Nikhil Dungawat submitted that the State had not complied with the Court's directions dated April 22, 2024.
In that earlier order, the Court had required the government to provide a detailed account of the audit findings, the stage of criminal proceedings initiated, disciplinary action against erring officials, year-wise monetary losses to the exchequer caused by unlawful exemptions and disbursements, and whether the audit had been approved by the chief auditor of the state. The state was also directed to clarify steps taken to recover records from co-operative societies that had withheld them from audit. In response, additional advocate general placed reliance on an affidavit sworn by Mohd. Haroon Belim on November 18, 2024. However, the bench pointed out that the affidavit only referred to "oral directions" allegedly given by the court on August 28, 2024, and not to the explicit directions contained in the April 2024 order. "This only reflects a pathetic show by the state and also gives an impression that it is attempting to cover up and not cooperate even with the court," it observed....
