PRAYAGRAJ, Aug. 6 -- Holding that any kind of abstinence from professional duty by lawyers on a call by the bar association is "absolutely illegal", the Allahabad high court observed that accepting such strike resolution may amount to misconduct on the part of the judge/presiding officer concerned. A single-judge bench of justice JJ Munir made these observations while pulling up a sub-judicial magistrate (SDM) for adjourning a case in pursuance of a resolution of a Bar Association of Aligarh calling upon lawyers to abstain from judicial work. "Accepting such a strike resolution may amount to misconduct on the part of the presiding officer and could invite a recommendation for disciplinary action, including removal from office," the court added. The court also issued a show-cause notice to the officer concerned, asking her why appropriate action should not be taken against her for adjourning a case in view of the Bar's resolution. The case pertains to a restoration application filed by Satyapal Singh before the SDM in a matter related to UP Revenue Code, 2006. The case was adjourned on July 25, 2025 since the advocates were abstaining from work on that day. The matter was fixed for July 28. The high court, in its order dated July 28, issued a show-cause notice to the SDM while fixing August 6 as the next date of hearing in the matter. htc...
