HC dismisses claim of 3 shopkeepers
PRAYAGRAJ, Nov. 19 -- The Allahabad high court dismissed the claims relating to three shops in the Shri Krishna Janmabhoomi complex and directed the trial court to complete the eviction process against them within two months.
Justice Rohit Ranjan Agarwal in a decision dated November 17 dismissed the petitions of the shopkeepers and directed the trial court to complete the pending eviction proceedings against the shopkeepers within two months.
The Shri Krishna Janmasthan Seva Sansthan, which manages the temple, had filed eviction suits against three shops (number 8-A, 8, and 16-17) after their 11-month licence periods expired and they refused to vacate the premises.
The shopkeepers argued that the Sansthan was not a public religious or charitable trust and that the Uttar Pradesh Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, which offers more protection to tenants, should apply.
The HC examined the trust's founding documents and determined its purpose was to perform religious and welfare work for Hindus worldwide, thus classifying it as a "public religious and charitable institution".
