LUCKNOW, June 12 -- The Lucknow bench of the Allahabad high court on Wednesday directed the divisional commissioner, Lucknow, to appear before it on June 12, in response to a public interest litigation (PIL) petition, challenging the proposed auction for demolition of the main building of family court in Lucknow. This order was passed by a vacation division bench of justice Saurabh Lavania and justice Syed Qamar Hasan Rizvi on June 11 on the PIL filed by social activist Gautam Bharati. "Let divisional commissioner, Lucknow, who is said to be competent authority in terms of notification dated 25.02.2014 issued by ministry of culture, Govt of India, appear in person before this court along with relevant records to assist the court," the court ordered, listing the matter on June 12 as fresh. The petitioner sought directives for quashing of auction for demolition of main building of the court. He requested to direct respondents - state aurhorities to declare the main building of the family court, Nazarat building, administrative building, copying dept, record room building, all residences of class IV employees, all 4 court rooms with chamber and balcony and 37 chambers of advocates as monument of national importance under Section 4 of Ancient Monuments and Archaeological Sites and Remains Act, 1958, and give it status of 'protected monument'. The petitioner's counsel AN Tripathi contended that the family court building, also known as 'Chandi Wali Baradari', is an old heritage structure of historical importance, serving as a living example of rich cultural and archaeological legacy of Awadh/Lucknow. He alleged that rather than preserving the monument/building, the respondents are 'adamant' about demolishing it to construct 12 new courtrooms for family court, even though such construction cannot proceed without adherence to heritage assessment, as mandated under National Building Code, 2016.
