HC adjourns Jama Masjid-Harihar Temple dispute hearing to May 5
PRAYAGRAJ, April 29 -- The Allahabad high court on Monday adjourned the hearing in the dispute concerning the Shahi Jama Masjid and Harihar Temple in Sambhal, to May 5, after the Archaeological Survey of India (ASI) sought additional time to submit its reply.
When the matter came up before Justice Rohit Ranjan Agarwal, counsel for the ASI requested an extension for filing a counter affidavit. Granting the request, the court allowed 48 hours for ASI to file its response and provided one week to the mosque committee for submitting a rejoinder.
The case involves a civil revision petition filed by the committee of management, Jami Masjid, Ahmed Marg, Kot, Sambhal. The committee has challenged an earlier order of a Sambhal civil court, which had appointed an advocate commissioner to conduct a survey at the disputed site. The HC had earlier stayed the trial court proceedings pending before the district court in Sambhal, where the Hindu side had sought a declaration asserting their right of access to the Shri Harihar Temple, alleged to be situated at the current Jama Masjid premises.
The civil revision petition follows directions from the Supreme Court in a related matter. It challenges the maintainability of the suit filed before the Sambhal district court.
The petitioners from the mosque committee allege that the original suit was filed on the afternoon of November 19, 2024, and within a few hours, the civil court appointed an advocate commissioner to survey the mosque. Surveys were conducted on November 19 and again on November 24, 2024, with the court ordering that the report be submitted by November 29, 2024.
The underlying suit, filed by Hari Shankar Jain and seven others, claims that the Shahi Eidgah mosque was constructed after demolishing the Harihar Temple at Sambhal.
