PRAYAGRAJ, Nov. 22 -- The Allahabad high court on Thursday directed secretary, UP Basic Education Board (Prayagraj), to appear before it on November 25 as it was not satisfied with the explanation given by the officer for not considering the transfer request of a teacher suffering from cancer. Earlier, the court had expressed displeasure over the conduct of the officer for rejecting the transfer representation of an assistant teacher suffering from cancer, despite a specific prior direction by the court to consider her case 'sympathetically'. Justice Prakash Padia was hearing a petition filed by Kalpana Sharma, an assistant teacher posted at a junior high school in Shahjahanpur who had sought her transfer to Ghaziabad as she was suffering from breast cancer and was currently receiving chemotherapy at the Max Cancer Centre in Ghaziabad. The court observed that it was "very much shocked and surprised" that the authorities, instead of considering the case of the petitioner sympathetically, rejected her request on a technical ground. The ground taken for refusal of transfer was that there are only two teachers in the institution where the petitioner is working, and the school requires three teachers because it has at least 36 students. Expressing surprise over the ground taken, the bench added that every day it is dealing with matters where, in large number of institutions, where more than 36 students are there, only one teacher is working. The court observed, "After going through the same, the court is not at all satisfied with the explanation as has been given by the secretary of the board in the aforesaid affidavit." In September last year, the court had disposed of the petitioner's earlier plea by directing the authorities to decide her representation "sympathetically", in view of the fact that she is undergoing treatment at Max Cancer Centre, Ghaziabad.
