Dehradun, July 21 -- The Dehradun police has registered a first information report (FIR) against folk singer Pawan Semwal for allegedly insulting women and promoting enmity in his video song on chief minister Pushkar Singh Dhami. The FIR was registered at Patel Nagar police station under sections 79 (Word, gesture or act intended to insult the modesty of a woman), 196 (Promoting enmity between different groups on grounds of religion, race, place of birth, residence, language,etc., and doing acts prejudicial to maintenance of harmony), 353 (1) (b) (Statements conducing to public mischief) of the Bharatiya Nyaya Sanhita (BNS) on Saturday evening on the complaint of a 34-year-old Patel Nagar resident, Manju. In the Garhwali song, titled Tin Bhi Ni Thami (It is beyond your capacity), the lyrics claim that "corruption and hooliganism are rampant in the state, people are helpless on the streets, daughters are being raped, there is a proliferation of liquor shops, and prostitution is flourishing." The woman in her complaint stated that the song was published on YouTube channel Bhuvneshwari Production of singer Pawan Semwal. He also shared the song on his Facebook profile. "The statements, presented in the form of lyrics, clearly convey that helpless daughters are being raped and prostitution is flourishing in Uttarakhand. These lines amount to indecent and defamatory comments aimed at dishonouring and outraging the modesty of all women residing in the state. Such statements are not only factually misleading but are designed to project a negative and false image of the women of Uttarakhand across the nation. Given that Uttarakhand is a tourism-dependent state, such content also creates a sense of fear and insecurity among the general public and visitors," she said. "The singer had previously removed the video after initial objections. However, on July 19, has once again uploaded, broadcasted, and publicly shared the same song on his YouTube channel and Facebook ID, indicating deliberate intent. This act appears to be a wilful attempt to spread public hatred, disturb communal harmony, and incite anger among the local population against the state government and its institutional systems. By publishing such inflammatory content, the accused has tried to provoke social unrest and mislead the public," the complaint stated. In response, Semwal said the FIR against him was an attack on the right to free speech and expression provided by the Constitution. He said he was pressured by the police to remove the video but he will not do so even if he is jailed. "It is just a satirical song on the prevailing issues of the state. I have not targeted anyone through my song....I will not remove the song...even if I am put behind the bars....it is an attack on the right to free speech and expression provided by the Constitution. I have been singing songs on people-oriented issues, culture and devotional music for two decades," he said. He said he was picked up by the police in the middle of night from his house in Delhi as if "he had committed a murder". State Congress president Karan Mahara condemned the police action and said it is purely vindictive and an attempt to suppress the free voices....
