Dabur says FSSAI cannot deny use of '100%' claim
New Delhi, May 18 -- Consumer goods major Dabur has moved the Delhi high court seeking protection from coercive action against Food Safety and Standards Authority of India (FSSAI) on import and sale of its ACTIV range of fruit juice having the modified label of "100% no added sugar and preservative".
Dabur's application, expected to be heard next week, said though it modified its label from "100% fruit juice" to "100% no added sugar and preservative" in compliance with FSSAI's notification, the food regulator had objected to the "100%" claim.
The regulator in an affidavit said use of the claim "100%" was presumably prohibited since it was neither defined nor recognised under the FSS Act or the FSS Claims Regulations 2018.
In response, the FMCG major stated in its rejoinder that the FSSAI did not have the legislative competence to expressly prohibit the claim of "100%"....
