Can having smoke canisters in Parl attract UAPA: HC
New Delhi, May 8 -- The Delhi high court on Wednesday questioned the Delhi Police's decision to invoke anti-terror provisions under the Unlawful Activities (Prevention) Act (UAPA) against four accused in the December 13, 2023 Parliament security breach, asking whether carrying smoke canisters and protesting outside the House amounted to a terror act.
The court was hearing the bail plea of Neelam Azad, one of four people arrested in connection with the December 13, 2023 incident. Azad, along with Sagar Sharma, Manoranjan D, and Amol Shinde, is accused of orchestrating a protest involving coloured smoke canisters.
A bench of justices Subramonium Prasad and Harish Vaidyanathan Shankar said the offence was unquestionably serious, and Parliament was no place for pranks or protest, but asked if it warranted prosecution under UAPA, which has far stricter provisions. "They weren't even inside the Parliament. Had they been, our view may have been different," the bench observed.
"Can having smoke canisters inside and outside Parliament attract UAPA?" the bench asked....
