Bihar BJP MLA, his aide jailed for 2 years in 2019 assault case
Darbhanga, May 28 -- A special court in Darbhanga on Tuesday sentenced Bharatiya Janata Party MLA Mishri Lal Yadav and his aide Suresh Yadav to two years of rigorous imprisonment along with a fine of Rs.1 lakh each in connection with a January 2019 assault case.
District and additional sessions judge cum special judge Suman Kumar Diwakar was hearing an appeal filed by Umesh Mishra who sought enhanced punishment for the convicts. The MLA and his aide were earlier sentenced to three months imprisonment and a fine of Rs.500 each on February 21 this year. In its Tuesday verdict, the court said non-payment of the fine would invite an additional one-month imprisonment for both the convicts.
Mishra lodged a complaint on January 30, 2019. He said in his complaint that the previous day around 6am he was out for a morning stroll in his village. From his village, Samaila, he reached Gosaitol village where he alleged he was confronted and attacked by MLA Mishri Lal Yadav, Suresh Yadav and around 20-25 armed people.
Mishra was beaten up, and the MLA hit him on the head while Suresh Yadav assaulted him with rods and lathis and snatched Rs.2,300 from his pocket, special public prosecutor Renu Jha said.
The public prosecutor added that during the hearing, the defence counsel requested the court to extend the benefit of the 'Probation of Offenders Act', saying that it was the first offence by both accused.
However, the court rejected the plea. MLA Mishri Lal Yadav said he has full faith in the judiciary and will challenge the order in the Patna High Court....
