Agra, July 2 -- The Special Judge (Exclusive Court, POCSO Act) in Etah has rejected the closure report for the second time in a case involving the alleged sexual assault of a minor Dalit girl. The court has now registered the matter as a complaint case. The case, dating back to April 1, 2019, was registered at Jalesar police station under IPC sections 354(b) (assault or use of criminal force with intent to disrobe), 506 (criminal intimidation), provisions of the SC/ST Act, and the POCSO Act. The complaint was filed by the girl's father, alleging that the accused, a local shopkeeper named Veeresh, assaulted his daughter while she was returning home from school. Initially, police refused to register the FIR, prompting the complainant to move an application under Section 156(3) CrPC. The court directed registration of the case on June 7, 2019. However, the Investigating Officer later filed a final report, stating no offence had occurred, attributing the incident to a dispute over unpaid 'samosa'. According to the IO, the accused had refused to serve the girl a samosa due to pending payment, which allegedly led to a verbal spat with her family and, subsequently, a false allegation of sexual assault. The victim's father filed a protest petition on June 27, 2025, highlighting that the girl had clearly stated in her Section 161 CrPC statement that she was sexually assaulted. The court, noting discrepancies in the investigation, rejected the police report again and ordered that the matter be treated as a complaint case. During the hearing, the victim's counsel alleged that the closure report was influenced by a bribe of six samosas. Denying the claim, Circle Officer (Jalesar) Gyanendra Kumar said: "The IO found no offence in the case and submitted the final report accordingly.
