Lucknow, July 20 -- Hearing petitions challenging the Bahraich district magistrate's order denying permission for the 'Jeth Mela' at Ghazi Miyan Dargah, the Lucknow bench of the Allahabad high court has observed that in normal course, all such ritualistic practices which stand recognised since time immemorial cannot be obstructed by the state on trivial grounds, particularly when such practices promote cultural harmony in the society. Rituals and usages know no boundaries and sometimes they reach the zenith of faith at a particular shrine or a religious place of worship, the court said. A division bench of Justice AR Masoodi and Justice Subhash Vidyarthi made the observations on July 17 while disposing of petitions filed by the Dargah committee and others. The petitioners had approached the court challenging the Bahraich district magistrate's order dated April 26, 2025 that denied permission for the mela. The DM had cited a report by the LIU that raised concerns over potential law and order issues if the fair were to be held. The Jeth Mela was scheduled to be held in May. Terming the DM's decision as contrary to legal provisions, the committee urged the court to direct the administration to allow the event. Disposing of the petitions, the court directed, "Moreover, the Committee of Management of Dargah Sharif shall henceforth ensure that the management of 'Urs' and 'Mela' shall be dealt with effectively by installing CCTV cameras at the entry/relevant places, particularly during the Jeth Mela as well as the Urs..." The court said the state government's impugned order has lost its efficacy, consequent upon the period of Mela being over. The interim arrangement made by this court permitting the performance of rituals has rather dispelled the apprehensions of the state, it added. Therefore, the relief requested for stands virtually granted due to non-interference by the state in the routine practices as stated by the additional advocate general for the state, the court said.
