PRAYAGRAJ, Oct. 15 -- While hearing a habeas corpus petition, the Allahabad high court on Tuesday took a serious note of alleged forcing of petitioner by the Farrukhabad Police to withdraw this petition and directed the superintendent of police (SP), Farrukhabad, to remain present before the court on October 15 (Wednesday). As per an earlier direction of the court, the SP, Farrukhabad was present before the court on Tuesday too. The above order was passed by a division bench comprising Justice JJ Munir and Justice Sanjiv Kumar while hearing a habeas corpus writ petition filed by one Preeti Yadav. Yadav had filed the petition by alleging that her husband was illegally detained by the police officials and she was forced to sign on some papers by the police. Earlier, on October 9, while hearing the petition, the court had issued notices to Anurag Mishra, station house officer, Kayamganj police station, Farrukhabad, the circle officer, Kayamganj, Farrukhabad and the SP, Farrukhabad, to appear in person before this court on October 14. In the same order, the court had also restrained those officers and other police officers from contacting, threatening or otherwise, harassing the petitioner. In the supplementary affidavit filed on behalf of the petitioner, it was alleged that the second and the third petitioners were illegally detained by the respondent police authorities on September 8 night and released on September 14 night. It was also alleged that during this detention, she was forced to write a letter. However, during the court proceedings on Tuesday, the state government counsel requested the court to take up this case on Wednesday (Oct 15) in order to enable them to file an affidavit, which would also give them opportunity to answer the allegations made in the affidavit of the petitioner filed on Tuesday. Another affidavit was filed by counsel for the petitioner, which the court took on record. The court also directed the SP, Farrukhabad, to answer this affidavit on Wednesday.
