Hizb chief's two sons move HC, seek restoration of calling right
New Delhi, May 10 -- Hizb-ul-Mujahideen chief Syed Salahuddin's two sons, who are presently in Tihar Jail in connection with a terror funding case, have approached the Delhi high court to restore their phone call facility, claiming that its been a year they have been able to speak to their family after this facility was denied by the jail authorities.
In an application moved before the high court, Syed Ahmad Shakeel and Syed Shahid Yusuf sought a direction to the jail authorities to restore the phone call facility available to all inmates.
Their father Syed Salahuddin is a designated global terrorist and is one of the wanted criminals in India for his role in orchestrating terror attacks.
His sons were arrested by the National Investigation Agency (NIA) in connection with a 2011 terror funding case in Jammu and Kashmir involving hawala transactions.
Yusuf was arrested in October 2017 and Shakeel was taken into custody in August 2018.
The application by the duo came up for hearing on Friday before a bench of chief justice DK Upadhyay and justice Tushar Rao Gedela. However, it was adjourned for May 22.
The application was filed in their pending petition challenging the constitutionality of Rule 631 of the Delhi Prisons Rules, 2018. This rule allows prisoners covered under it to avail communication facilities after seeking prior approval of the deputy inspector general.
Those covered by the rule include people charged in offences against the state, for terrorist activities and heinous crimes, under laws such as the Maharashtra Control of Organized Crime Act, the National Security Act and the Public Safety Act, and inmates who are frequently involved in assaulting co-inmates.
In his petition, Shakeel had alleged that the number of calls as a consequence of the rule was reduced from five calls per week to one per week, but after April 2024, he could not contact his family since he was denied the said facility....
