JODHPUR, June 17 -- The Rajasthan high court on Friday dismissed a writ petition filed by over 100 residents of Sundar Balaji Colony in Chopasni Jagir, Jodhpur, who sought protection from eviction on the grounds that they had been residing in the area for nearly two decades. The court ruled that the land fell within the catchment area of Ummed Sagar Dam and was owned by the public health engineering Department (PHED), thereby making any occupation illegal. Justice Sunil Beniwal, while dismissing the petition, observed: "It is true that no document has been placed on record to suggest that any of the petitioners possess title over the land in question... The petitioners are, undisputedly, encroachers and, therefore, no indulgence can be granted by this Court." The court further held that in the absence of title or ownership documents, the petitioners were not entitled to relief under Article 226 of the Constitution....
