JODHPUR, July 19 -- The Rajasthan high court on Friday dismissed a writ petition challenging the reorganisation of Bengu municipality in Chittorgarh district, upholding the state government's authority to restructure municipal boundaries under the Rajasthan Municipalities Act, 2009. A division bench of Justice Shree Chandrashekhar and Justice Sandeep Shah delivered the ruling while rejecting the plea filed by Daulat Ram and Shambhu Lal, residents of Haripura village in Begun tehsil. The petitioners had challenged two notifications issued on March 25 and March 27, 2025, concerning the reconstitution of municipal boundaries and the proposal for ward delimitation in the newly restructured Bengu municipality. The bench held that the notifications were legally valid and within the powers conferred upon the state government. Citing Section 3 of the Rajasthan Municipalities Act, the court said, "The State Government may, by notification published in the Official Gazette, declare any local area not included within the limits of a Municipality to be a Municipality, or include any such area in a Municipality, or exclude any local area from a Municipality, or otherwise alter the limits of any Municipality." The court further observed that under sub-section (10) of the same provision, the Act has an overriding effect over the Rajasthan Panchayati Raj Act, 1994 or any other law in force, and thus cannot be challenged on grounds of legislative competence....
