NGT orders strict action to protect Ana Sagar Lake
JODHPUR, Nov. 7 -- The central bench of the National Green Tribunal (NGT) directed the Municipal Corporation and district collector to ensure strict compliance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974, regarding pollution and illegal constructions in Ajmer's Ana Sagar Lake.
The bench, comprising judicial member justice Sheo Kumar Singh and expert member Sudhir Kumar Chaturvedi, while disposing of the application filed by petitioner Babulal Sahu, on Tuesday directed that the collector and Municipal commissioner shall ensure strict compliance with Section 4 of the Wetland Rules and ensure that there is no encroachment on the wetland or water body, no construction activity, discharge of untreated water, or dumping of garbage, solid waste, or plastic waste in the lake. The constructions raised during the pendency of this application and those already raised prior to it in violation of Section 4 of the Wetland Rules must be demolished immediately at the cost of the Municipal Corporation after proper identification and measurement of the area.
The bench ordered: "The amount of environmental damage assessed by the Rajasthan State Pollution Control Board to the tune of Rs.38,75,70,000 may be recovered by the competent authority according to rules and due process of law after providing an opportunity of hearing, and the aggrieved shall have a right to file an appeal before the appropriate forum. After completion and satisfactory operation of the Sewage Treatment Plant (STP), the Municipal Council may file an application for adjustment against the cost of construction of the STP before the Tribunal."
"A wetland action plan is a strategic approach to wetland conservation, management, and rejuvenation. Therefore, the Municipal Commissioner is directed to prepare a wetland action plan for Ana Sagar Lake as per the norms provided in the Wetland (Conservation and Management) Rules, 2017, within three months by engaging experts in this field. Effective implementation of the action plan shall be initiated accordingly for the long-term conservation of Ana Sagar Wetland. The State Pollution Control Board is directed to periodically monitor the status, and in case of violation, necessary remedial action must be taken in addition to prosecution and realization of environmental damage," it added....
