NGT asks DC to look into encroachments on canal
JODHPUR, July 26 -- The National Green Tribunal, Bhopal, has directed the Jaipur district collector to intervene and ensure the correction of revenue records that have led to the obstruction of the Chaparwada Dam canal system and directed the removal of encroachments found on dam or canal land in violation of environmental laws.
The Chaparwada Dam, which is the subject of the dispute, is located in Jaipur district. The judgment was delivered by a division bench comprising justice Sheo Kumar Singh and expert member Dr. A. Senthil Vel on Wednesday.
The Tribunal said, "The dam and old canal is existing there but due to certain ambiguity in the revenue records, private individuals have levelled the land and in this way the existence of canal is in danger and may hit the supply of water."
The original application was filed by local resident Kamlesh Roj, raising alarm over the encroachments and pollution degrading the Chaparwada Dam, which was constructed during the British era and completed in 1894. The dam, critical for irrigation in the Dudu region, receives water from the Kalakh Dam Feeder and Etakhoi (Itakhoi) Feeder. However, unchecked encroachments, particularly on Gair Mumkin Pal (buffer lands) and catchment areas, have reportedly blocked water channels, leading to severe ecological imbalance and disruption in irrigation supply.
During the proceedings, the Tribunal took note of a joint committee report highlighting how portions of the canal were recorded under private ownership. These areas had been levelled and cultivated, impeding the natural flow of water. The Tribunal maintained that correction of revenue records must be prioritised and directed that appropriate legal action be taken in case of encroachment.
The Tribunal concluded by stating: "We direct the Collector. to see the matter personally and ensure that the matter of correction of revenue records must be resolved according to rules. In case of any encroachment in violation of any laws, the necessary action must be initiated to remove encroachments."...
