HC summons law secy, tribunal chief over non-operational bench
JODHPUR, Nov. 8 -- The high court on Friday summoned the principal law secretary and the chairman of the Rajasthan civil service appellate tribunal in Jodhpur to appear in person on Monday, while taking serious note of the non-functioning of the Tribunal's permanent bench and the failure to comply with the court's previous directions.
Counsel Anil Bhandari, representing the high court advocates association, told the division bench of justice Pushpendra Singh Bhati and justice Anurup Singhi that the state government had issued a notification on May 4, 2023, to establish the permanent bench of the Tribunal and had also appointed staff. He said that on September 12, 2023, the Tribunal issued an order defining Jodhpur's jurisdiction, directing that pending and new cases from all districts of Jodhpur, Udaipur, Bikaner, Pali, and Banswara divisions be heard in Jodhpur.
However, despite the appointments, the Tribunal's permanent bench in Jodhpur has not become operational.
The bench observed, "The frequent and repeated violations of court orders and non-compliance with the state's own notification regarding the operation and functioning of the permanent bench of the Rajasthan Civil Services Appellate Tribunal at Jodhpur is contemptuous. This court is particularly peeved by the limited compliance despite repeated directions."
"The principal law secretary and the chairman of the tribunal, shall remain present on November 10, 2025, to explain the circumstances leading to such a lapse. The Court shall consider initiating contempt proceedings against the respondents depending on their explanation," the bench ordered....
