JODHPUR, Sept. 2 -- The Rajasthan high court has directed the state government to explain its policy of allotting liquor shops in densely populated public areas, particularly those located near temples, schools, and other sensitive places, a lawyer, familiar with the case, said. Hearing a petition filed by Sadhana Shivhare, Justice Sameer Jain observed that liquor falls within the ambit of res extra commercium (things outside commerce) under Article 47 of the Constitution, which obligates the state to discourage intoxicating drinks and drugs. "The State shall endeavour to bring about prohibition of the consumption, except for medicinal purposes, of intoxicating drinks and drugs which are injurious to health," the court quoted from Article 47. The petitioner, who has been running a liquor shop at Kishanpole Bazar in Jaipur since 2021-22, challenged a notice dated August 13, 2025, directing her to shift the shop due to public resentment.
