Jodhpur, May 7 -- The Rajasthan high court on Tuesday dismissed an election petition challenging the election of Hanumangarh MLA Ganeshraj Bansal, and stated that once the police has filed a negative final report, the candidate submitting nomination papers is not required to disclose those cases. Justice Dinesh Mehta, while pronouncing the verdict, upheld the preliminary objections raised by Bansal and rejected the petition filed under Sections 80-A, 81, and 100 of the Representation of the People Act, 1951. The court noted that the petition lacked essential pleadings and failed to disclose a cause of action. The petitioner alleged that Bansal concealed certain pending criminal cases while filing his nomination for the December 2023 assembly elections. However, the court found that the allegations were vague and unsupported by necessary details. The court observed: "The petitioner has neither brought to the Court's notice any statutory provision nor any precedent which enjoins upon a candidate to furnish information even in those cases wherein the police has given him a clean chit." It further clarified: "Mere enclosure of the negative Final Report, that too regarding 3-4 cases, without there being any assertion and pleading in this regard is not sufficient, more particularly when it comes to an election petition." The court also pointed out that the petitioner did not provide even basic details such as FIR numbers, names of police stations, or particulars of the courts where such cases were allegedly pending, and emphasised that the right to challenge an election is governed strictly by statutory provisions.
