HC questions Udaipur police arrests in Vikram Bhatt case
JODHPUR, Dec. 13 -- The Rajasthan high court has questioned the actions of the Udaipur police in a case involving film director and producer Vikram Praveen Bhatt, directing the Inspector General of Police, Udaipur Range, the Superintendent of Police, Udaipur, and the investigating officer to appear before the court through video conferencing on the next hearing.
The single bench of Justice Sameer Jain heard the petition filed by Bhatt and others. The petitioners argued that the case arises from a contractual dispute related to two films made under an agreement worth about Rs.42 crore, which they say was fully executed. Despite this, Vikram Bhatt, his wife, and employees were arrested on Sunday. They also pointed out that the FIR invokes two mutually exclusive legal provisions, which they argued is not legally permissible.
The petitioners relied on Supreme Court judgments to submit that no preliminary inquiry was conducted before the arrests and that the dispute is civil in nature. They further claimed that the complainant acted in connivance with some employees.
The public prosecutor maintained the arrests were made lawfully after a preliminary inquiry. The complainant's counsel alleged expenses were inflated during the execution of the agreement.
After hearing both sides, the court said that the circumstances of the case require the personal explanation of senior police officers. It directed the IGP to clarify the matter before the court through video conferencing.
The court granted interim protection to the daughter of petitioner Vikram Bhatt. It ordered that no coercive action be taken against her, though she must not leave the country without permission. The matter will be heard again on 15 December....
