HC quashes FIR against doctors, hospital in RAS officer's death
Jodhpur, May 10 -- The Rajasthan High Court has quashed the FIR registered against doctors and management of Vasundhara Hospital, Jodhpur, in the case concerning the death of Rajasthan Administrative Service (RAS) officer Priyanka Bishnoi. She had undergone a fibroid surgery at the hospital in September 2024 and later died due to complications. The court ruled that no prima facie case of criminal negligence had been made out, and continuing proceedings would amount to misuse of the criminal justice process.
Justice Farjand Ali on Wednesday, while allowing the petitions filed by the doctors and hospital administrators, noted that both district-level and state-level expert medical committees found no evidence of gross or culpable negligence in the treatment provided. The FIR, registered on October 25, 2024, had invoked Section 105 of the Bharatiya Nyaya Sanhita (earlier Section 304 IPC), alleging culpable medical negligence.
