HC grants six months of interim bail to self-styled godman Asaram
JODHPUR, Oct. 30 -- The Rajasthan high court on Wednesday granted six months interim bail to self-styled godman Asaram Bapu (86), who is serving a life sentence for the rape of a minor, while hearing a petition seeking suspension of his sentence.
Senior counsel Devadatt Kamat presented arguments on the suspension of sentence application before a division bench of acting Chief Justice Sanjeev Prakash Sharma and Justice Sangeeta Sharma.
Kamat's associate counsel, Yashpal Singh Rajpurohit, said the division bench granted six months interim bail to Asaram.
He added that interim bail had previously been granted in the presence of police officers, but this condition has now been removed.
During the hearing, it was noted that the petitioner has been in judicial custody since September 2013 and has spent nearly 13 years in prison.
His appeal against his conviction earlier, has been pending since 2018 and is unlikely to be heard soon, people aware of the matter said..
The petition states that Asaram's health is critical. He is described as a high-risk patient suffering from several serious diseases.
The petition also claims that Asaram has previously suffered four cardiac attacks and has severe coronary artery disease.
The petition includes a medical report from AIIMS Jodhpur, citing severe osteoporosis, sarcopenia, chronic kidney disease, type-2 diabetes, hypertension, and frequent chest pain.
The petition argues that the prison environment is harmful for the self-styled godman's health condition.
Citing a Supreme Court judgment, the petition further states that convicts who have completed ten years or more of their sentence should generally be granted bail until their appeal is decided by a court.
Asaram was arrested in 2013 for raping a minor at his Jodhpur ashram.
After trial, he was sentenced to life imprisonment in 2018 under the POCSO Act....
