Jodhpur, May 27 -- The Rajasthan high court on Monday restrained the state government from issuing any notifications regarding restructuring of gram panchayats, until a high-level committee examines the proposals and submits its findings to the court. The order was issued by a single bench of justice Dinesh Mehta, which was hearing a batch of nearly 60 writ petitions challenging various proposals for restructuring gram panchayats in different districts. The court observed that the petitioners raised serious questions involving not just individual grievances but also fundamental violations of the state government's own guidelines issued on January 10, 2025. The court took note of multiple procedural and administrative inconsistencies, including the inclusion of villages located more than six kilometers away from the proposed panchayat headquarters, arbitrary exclusion of well-developed or populous villages, and proposal of panchayat offices in villages with neither adequate population nor government land for infrastructure development. One of the major concerns flagged by the petitioners was the inclusion of revenue villages that are either yet to be formally constituted or are part of ongoing litigations in which interim orders have already been passed or previous notifications have been quashed. Referring to these irregularities, the court noted: "The impugned proposals appear to be arbitrary and contrary to the rights of the villagers apart from being violative of the guidelines." Highlighting the need for impartial review, the HC was informed by advocate general Rajendra Prasad that the government has constituted a three-member high-level committee to scrutinise the proposals forwarded by various district collectors. The court noted that according to prevailing guidelines, the proposals are not considered final unless they are reviewed in light of objections raised by the affected villagers. The court ruled that: "The State shall not notify the creation of gram panchayats until the adjudication made by the above referred Committee is placed for consideration of the Court."
