Jodhpur, May 3 -- Observing that "right to education is the fundamental right of every child", the Rajasthan high court on Friday granted permission to the superintendent of Government Balika Grah to admit an 11-year-old rape survivor-currently residing in the government-run shelter home-in any nearby government school and to bear all educational expenses until she attains majority. The minor girl, who was admitted to Balika Grah in compliance with the Court's earlier order dated January 17, 2024, had given birth to a child last year as a result of sexual assault. In accordance with that order, the court had directed that the child, upon birth, be handed over to the Child Welfare Committee for adoption through the Central Adoption Resource Authority (CARA), while the petitioner be allowed to continue residing at Balika Grah and be provided with all necessary facilities, including medical care, nutritious food, privacy, and educational opportunities. Noting that the child is now eager to pursue her studies, the court observed: "Looking to her interest in studies and her wish to undergo studies, this Court deems it just and proper to grant permission to the superintendent, Government Balika Grah, Department of Child Rights, Jaipur to admit the victim in any Government School situated nearby the vicinity of Balika Grah and bear expenses of her studies and provide her necessary books and study material to continue her studies till attaining the age of majority."...
