Delay in BJP MLA's disqualification: LoP urges Guv to step in
Jaipur, May 16 -- Leader of opposition Tikaram Jully on Thursday urged governor Haribhau Bagade to intervene as Bharatiya Janata Party MLA Kanwar Lal Meena has not been disqualified even two weeks after the Rajasthan high court upheld his conviction in a 20-year-old criminal case and a week after the Supreme Court asked the MLA to surrender.
"Almost two weeks have passed since the Rajasthan high court upheld Meena's three year sentence in a 20-year-old criminal case and the Supreme Court too has dismissed Meena's special leave petition on May 7, 2025. As per the Representation of the People Act, any public representative who is sentenced to more than two years stands disqualified from holding office," Jully told reporters.
"The speaker is blatantly disregarding his constitutional duty," he said. He said when Congress leader Rahul Gandhi was convicted by a Surat court and sentenced to two years imprisonment in March 2023, Gandhi was disqualified from the Lok Sabha the very next day.
The opposition leader submitted a letter to the governor regarding the same on Tuesday.
Meena is accused of putting a gun to the head of Anta SDM Ramniwas Mehta and threatening to kill him, on January 3, 2005. Meena along with villagers had reached the SDM's office to stage a dharna to demand a recount in the deputy sarpanch election in Khatakhedi. Meena also threatened the IAS probationer Preetam B Yashwant and the tehsildar and broke the camera of the government videographer.
On December 14, 2020, the Jhalawar ADJ court sentenced Meena to three years imprisonment. Meena challenged the verdict in the high court which upheld the lower court order on May 1. Meena approached the SC and filed a special leave petition but the apex court on May 7 dismissed his petition and asked him to surrender within two weeks. Speaker Vasudev Devnani said he has been seeking legal opinion in the matter but has not taken any decision so far.
Congress leader and advocate Satyendra Raghav said the law is very clear on this and there is no scope for confusion. "As per the Representation of the People Act, 1951, from the day he was convicted, he stands disqualified for six years. the supreme court too has upheld his sentence. I don't think Meena has any legal redress," he said....
