Del court orders case against Alwar ex-MP
JODHPUR, Nov. 13 -- Delhi's Special Court (MPs-MLAs Cases) has found "sufficient grounds" to prosecute Bhanwar Jitendra Singh, former Alwar MP and ex-Union minister of state, for criminal breach of trust in a case related to his refusal to return an MF Husain painting to former MP Prabha Thakur, a lawyer familiar with the case said on Wednesday.
Special judge Jitendra Singh passed the order on Tuesday, the lawyer said, adding the court set aside the trial court's order. Singh and the complainant have been directed to appear before the trial court on November 25.
The case relates to a complaint filed by Mumbai-based art collector Rohit Singh Mahiyaria. The complaint alleged that in 2014, Bhanwar Jitendra Singh had borrowed a Ganesha painting by artist MF Husain from his mother, former MP Dr Prabha Thakur, but did not return it. Dr Thakur told the court that she had purchased it for Rs.22.5 lakh, which had a market value of Rs.1 crore. She said she gave the painting to Singh to show it to his wife to consider buying. He later did not return it or respond.
"The material available on record prima facie discloses sufficient grounds to proceed against the respondent for the offence punishable under Section 406 of IPC. Accordingly, the impugned order dismissing the complaint under Section 203 CrPC is set aside. The trial court is directed to proceed further in accordance with law... The complainant and respondent are directed to appear before trial court on November 25, for further proceedings," the court said....
