Jaipur, May 6 -- The political row has intensified after the Rajasthan high court upheld the three-year sentence of BJP MLA Kanwarlal Meena in a case where he was found guilty of training a pistol at a then SDM. On Monday, a Congress delegation led by Leader of Opposition Tikaram Jully and Rajasthan Pradesh Congress Committee president Govind Singh Dotasara met the secretary of the Rajasthan legislative assembly. They submitted a formal letter addressed to the speaker, demanding the immediate termination of Meena's assembly membership. The delegation also submitted a certified copy of the high court order, urging that Meena's membership be cancelled effective from May 1, and that he be declared ineligible to contest elections for the next six years as per legal provisions. Addressing the media, Meena said, "We have handed over the certified copy of the high court's order to the principal secretary of the assembly. Now, it is imperative that Kanwarlal Meena's membership be terminated without delay." The Congress leaders said that Meena has been sentenced to three years in prison, and under the law, any MP or MLA convicted for more than two years must be disqualified immediately. "The high court gave its verdict on May 1, and the law is clear. The assembly speaker earlier said he required a certified copy of the court order. Today, we've handed over that copy," Dotasara added. "There cannot be two sets of laws in this country. Rahul Gandhi's membership was terminated within 24 hours, and his residence vacated within seven days. We are not demanding that here - but the MLA's membership must be revoked without delay," Dotasara said, stressing the need for equal enforcement of legal provisions. Citing Section 8(3) of the Representation of the People Act, 1951, Jully said that any elected representative sentenced to two years or more is deemed disqualified from the date of conviction, and is further barred from contesting elections for the next six years. Referring to the landmark Lily Thomas vs. Union of India judgment delivered by the Supreme Court in July 2013, Jully reminded the speaker that the top court had clearly ruled that the disqualification of an MP or MLA takes effect immediately upon conviction and sentencing, without requiring further action. Jully's letter reinforces the Congress's demand for swift implementation of legal provisions and uniform application of the law, asserting that Kanwarlal Meena's assembly membership should be revoked with immediate effect.
