Certificate can't be withheld for pending fees as edu institute: hc
Jaipur, Dec. 7 -- Rajasthan high court has observed that any educational institute cannot withhold the certificates or any documents of a student to recover their fees.
The Jaipur bench of the high court presided over by justice Anuroop Singhi, on Friday put the observation while hearing a plea by a former MBBS student of Jaipur National University in which the petitioner pleaded to direct the university to release her original documents that were submitted to the authority during 2022 but they denied to return them when she withdrew from the course after third year and switched to a different university due to her health condition.
"It is a settled position of law that certificate of a student cannot be withheld for arrears of fees as educational institutes can claim no lien over the same and accordingly, directions were issued to return the original documents. Perusal of the documents available on record reveals that there is no solitary condition which permits the respondent university to withhold the documents of a studen," read the order copy.
The court directed the university to return her documents immediately....
