Chandigarh, May 28 -- The Punjab and Haryana high court on Tuesday rejected realty group M3M director Roop Bansal's request to withdraw a petition seeking quashing of an FIR filed by the Haryana anti-corruption bureau in April 2023 against him, his nephew and M3M official Ajay Parmar, and CBI court judge Sudhir Parmar. Appearing for Bansal, senior advocate Abhishek Manu Singhvi argued, "When an accused has the right to file a petition, he should also have the right to withdraw it." However, chief justice Sheel Nagu declined, stating, "The way this case has been conducted, I would decline your request of the withdrawal." The matter was posted for May 29. Notably, the court's detailed order neither mentions the withdrawal request nor records yielding to it. In the FIR, judge Sudhir Parmar, formerly special CBI judge at Panchkula, is accused of showing favouritism toward Roop Bansal, his brother Basant Bansal of M3M, and Lalit Goyal of IREO Group. The developers were accused in FIRs probed by the CBI and ED, which were pending in Parmar's court. The FIR invokes sections 7, 8, 11, and 13 of the Prevention of Corruption Act and Section 120-B of the IPC-pertaining to bribery, undue advantage by a public servant, criminal misconduct, and conspiracy. On May 23, Chief Justice Nagu rejected objections to withdraw the case from a judge to "preserve the dignity and honour of the institution". The decision to transfer the case was taken on May 10, two days before the presiding judge was to pronounce a final order. On Monday, the court hinted at possible "forum shopping" by the petitioner. "The present Special Bench has been created after carving out and encroaching upon the time meant for Division Bench-I, and it is unfortunate that such a request is made on behalf of the petitioner," it noted.
