Court upholds bail for minor in Dwarka crash
NEW DELHI, April 21 -- A Delhi court on Monday rejected a woman's plea challenging the bail granted to a minor accused of killing her 23-year-old son in a hit-and-run case in Dwarka, observing that the "ends of justice" would not be defeated if the juvenile remained out on bail.
Additional sessions judge Rajat Goyal of the Dwarka courts said that while underage driving and fatal accidents are "more common than we care to admit", the incident, though tragic, did not display the level of depravity required to shock the collective conscience of society.
The court held that the mother's apprehension that the juvenile or his family might tamper with evidence or influence witnesses was not sufficient to curtail his personal liberty under the Juvenile Justice Act. "There is no ground for setting aside the impugned order," the court said.
Advocate Aman Singh Bakshi, appearing for the victim's mother, Inna Makan, argued that the minor was a habitual offender with prior traffic challans and that the gravity of the offence warranted cancellation of bail. The court, however, found no merit in the submissions.
The Juvenile Justice Board had granted bail to the teenager on March 10, noting that the incident stemmed from a "lack of sufficient parental monitoring".
The accident occurred on February 3, when Sahil Dhaneshra was hit by a speeding SUV allegedly driven by the minor, who then rammed into a parked cab, injuring its driver....
