Trial to proceed against Sanjay Bhandari, says HC
New Delhi, Aug. 2 -- The Delhi high court on Friday refused to defer trial court proceedings initiated by the Enforcement Directorate (ED) to confiscate UK-based arms dealer Sanjay Bhandari's properties after he was declared as a fugitive economic offender (FEO).
Bhandari's lawyer Kapil Sibal urged justice Neena Bansal Krishna to defer the proceedings, arguing that any order on confiscation would render his appeal against the FEO tag as infructuous. Sibal submitted that there was no question of selling the properties since the ED had already attached them, adding that the trial court did not have sufficient material on record while declaring him as an FEO. The ED opposed the deferment, saying that the trial court had enough material while declaring him as an FEO and he had failed to establish a prima facie case for a stay.
