SC to suspend UP law taking control of temple in Mathura
New Delhi, Aug. 9 -- The Supreme Court on Friday said it will put in abeyance the contentious ordinance issued by the Uttar Pradesh government which is under challenge before the Allahabad high court for creating a trust to take over Mathura's Banke Bihari temple.
Reserving orders on a bunch of petitions that questioned the state's competence to issue the ordinance, the top court said that till such time the high court decides on the validity of the ordinance, an interim management committee headed by a former high court judge will run the affairs of the temple.
Both the temple management and members of the Sewayat Goswami community had approached the top court challenging the May 26 ordinance as well as a judgment of the top court passed on May 15, allowing state to use temple funds for a corridor project in a 5-kilometre space around the temple.
A bench of justices Surya Kant and Joymalya Bagchi said, "We will broadly indicate what we intend to do. We will delete that part of the judgment (of May 15) and we will grant you liberty to challenge the ordinance before the Allahabad high court."
The court further indicated, "Considering the tragedy of August 2022 when stampede at the temple killed two persons, we will constitute an interim committee headed by a former high court judge. The Trust created under the ordinance will not be given effect. Even the ordinance will not be given effect till the final decision by the high court."
Earlier, the top court had criticised the state for bringing the Shri Banke Bihari Ji Temple Trust Ordinance, 2025, in a "clandestine" manner with "tearing hurry" without consulting other stakeholders in the process....
