HC to hear Moitra's plea against Lokpal nod for CBI charge sheet
New Delhi, Nov. 18 -- The Delhi high court is set to hear on Tuesday Trinamool Congress (TMC) lawmaker Mahua Moitra's plea challenging the Lokpal of India's order granting sanction to the Central Bureau of Investigation (CBI) to file a charge sheet against her in the alleged cash-for-query case.
The petition, set to be heard by a bench of justices Anil Kshetarpal and Harish Vaidyanathan Shankar, challenges the November 12 order where Lokpal had invoked its powers under Section 20(7)(a) read with Section 23(1) of the Lokpal Act, and allowed CBI to file a charge sheet within four weeks, and mandated that a copy be submitted to Lokpal.
Moitra's petition challenges the order on the ground that it was passed without considering the detailed written and oral submissions of the petitioner, contrary to the scheme of the Lokpal Act, 2013.
"The Impugned Sanction Order is erroneous, de hors the provisions of the Lokpal Act and a gross violation of principles of natural justice, whereby arguments / submissions / filings were invited from the Petitioner and then completely ignored before issuing an order granting sanction under Section 20(7)(a) of the Lokpal Act," the petition said.htc...
