Ggm land deal case: Court summons M3M directors
New Delhi, Feb. 3 -- A Delhi court last week summoned the directors of M3M India Pvt. Ltd. in connection with an alleged fraudulent land deal in Gurugram valued at around Rs.450 crore, involving rival developer MGF Developments Ltd..
The order was passed by chief judicial magistrate Harshita Mishra of the Tis Hazari Courts on January 31, after taking cognisance of a chargesheet filed by the Economic Offences Wing of the Delhi Police in March 2022.
The case names M3M India and its directors, including Basant Bansal, Roop Bansal and Pankaj Bansal, along with several subsidiaries and allied companies. "From the perusal of the chargesheet, it prima facie appears that the accused persons induced the complainant company into entering into an agreement qua the exchange of land in Gurugram and subsequently defaulted in the payment and fraudulently got the land mutated for a building project," the court observed, summoning the accused for April 4.
The court took cognisance of offences under sections 120-B (criminal conspiracy), 420 (cheating), 406 (criminal breach of trust), and 34 (common intention). According to the FIR, in 2016, MGF agreed to transfer land parcels in Chauma, Gurugram, to the M3M group in exchange for other land and Rs.114 crore via post-dated cheques.
The prosecution said the contract said the transfer would be void if cheques were dishonoured. MGF alleged that the cheques were dishonoured, rendering the deal void, but M3M and its directors allegedly proceeded to mutate the land and apply for a construction licence, causing wrongful loss to MGF....
