1. WARD ACJ: I agree, for the reasons given by Leeming JA, that the appeal must be dismissed with costs. It is not necessary for me to comment on his Honour's observations at [248] - [256], which can await consideration when the issue arises for determination in a case where it will be dispositive.
2. I share Leeming JA's concern at the tendency of Mr Salmon to make repeated and unfounded allegations of fraud against legal practitioners, including Senior Counsel appearing for the respondents in this matter.
