1. This is an application involving a lease of premises at 43 Booth Street Annandale.
2. The appellant, Take Two Pty Ltd (Take Two) is the lessee and operates a cafe from the premises. The respondent (Hewson) is the lessor.
The proceedings
3. The key issue between the parties is the meaning of the lease when it refers to the basement area:
"Part Identifier 1/306865 being the whole of the ground floor and basement area of the building at 43 Booth Street, Annandale."
