Australia, April 19 -- New South Wales Land and Environment Court issued text of the following judgement on March 18:
1.BASTEN AJ: In 2013 Michele Jean Matheson (the claimant), suffered a psychiatric injury during her employment with Baptistcare NSW & ACT (the employer). She lodged with the Personal Injury Commission a claim for compensation for non-economic loss, under Pt 3, Div 4 of the Workers Compensation Act 1987 (NSW). Section 66 provides an entitlement to compensation where the injury results in permanent impairment. However, s 65A(3) states that no compensation is payable under the Division for a "primary psychological injury" unless the degree of permanent impairment is at least 15%.
