1. This is an appeal from an order made in the Consumer and Commercial Division of the Tribunal on 29 October 2024 dismissing the appellant's claim for compensation in an amount of $33,000.00.
2. The appellant is an owner of a 2005 Mitsubishi Lancer car that was set up as a performance vehicle with a high-performance engine. In August 2024 the engine failed due to overheating. It was uncontroversial that the damage was irreparable and that a replacement engine was needed to restore optimal performance and to maintain vehicle safety and functionality.
