In Kingshill Development No 1 Pty Ltd and Kingshill No 2 Pty Ltd v Port Stephens Council and Hunter and Central Coast Regional Planning Panel [2023] NSWLEC 1478 (Kingshill) a Commissioner dismissed the appeal of the refusal of a development application (DA) for a concept development for residential subdivision (Concept DA). The Concept DA was made pursuant to s 4.22 of the Environmental Planning and Assessment Act 1979 (EPA Act) and included Stage 1 for 'initial site preparation works and establishment of an in-perpetuity Conservation Area' (CA).
