1. This is a Class 1 Development Appeal pursuant to s 8.7 of the Environmental Planning and Assessment Act 1979 (EPA Act) against the respondent's refusal of the applicants' development application (DA21/0807) (Development Application) seeking consent for a rural land sharing community (RLSC) including approval for the use of three existing dwellings and two sheds and construction of a fourth dwelling, including pavilion (shade structure) and pool at Lot 2 in Deposited Plan 1119629, known as 160 Richards Deviation, Dunbible NSW (Subject Land).
