1. This decision concerns what costs orders should be made in this appeal (if any) with respect to the costs of:
* the unsuccessful appeal by Duplex Australia Pty Limited (the builder); and;
* its appeal against the costs order made against it in the appealed proceedings, which we have decided to redetermine on appeal. Our reasons for doing so are set out in our appeal decision: Duplex Australia Pty Limited v Hathaway [2024]
