1. BELL CJ: Based upon my own review of the record of the trial, I would reject the appeal against conviction. Mr Ramrakha, who appeared for the applicant, structured his submissions by focussing first on count 3, which involved the complainant performing oral sex on the applicant, before turning to count 2 which involved penile vaginal intercourse. While the reason for so structuring his submissions was forensically understandable, the actual sequence in which the physical events comprising the two counts occurred was important, as Stern JA has carefully explained.
