Shimla, Feb. 28 -- The Himachal Pradesh High Court on Friday declined to entertain a habeas corpus petition filed by a father seeking production and custody of his minor daughter, holding that custody disputes between parents must be adjudicated by the competent Guardian Court and not under writ jurisdiction.
The Division Bench comprising Chief Justice G.S. Sandhawalia and Justice Bipin C. Negi dismissed the petition on February 23.
The petitioner-father had sought issuance of a writ of habeas corpus for the production of his minor daughter, Yashika, alleging that the child's mother had taken her away. He also prayed for immediate custody, contending that the child's welfare was at risk and that her education had been disrupted.
